User Code of Conduct

In combination with many other services and applications offered by DingTalk (“DingTalk” or “we” or “us”), the live broadcast platform enables either organizational or individual users to achieve more possibilities and convenience in online collaborative office and remote education and other compatible purposes.

In order to maintain stable operation and order of the live broadcast platform of DingTalk, and protect the legitimate rights and interests of all users (including live broadcasters and audiences of the live broadcast) on the platform, we hereby formulated this User Code of Conduct to set out the rules and some necessary benchmarks for acceptable / unacceptable behaviours while you use the live broadcast services of DingTalk.

General Principles

DingTalk provides the live broadcast related tools and services primarily for online work and education purpose and other compatible purposes, such as group video conference, press conference, training, online class, event for companies, schools or universities. DingTalk shall not be used for any other commercial purposes including but not limited to entertainment, marketing, advertising.

This User Code of Conduct is an integral part of the DingTalk Terms of Service. As a user of the DingTalk’s online live broadcast services, you fully understand and agree that you must abide by this User Code of Conduct and be responsible for all of your conduct while using the online live broadcast services of DingTalk, including but without limitation to any contents you publish, any comments you made when using the live broadcast and broadcasting, and the liability and consequences as a result of your action and conduct.

Qualifications

For broadcasters (“Broadcaster”)

Ÿ   Register as a DingTalk user;

Ÿ   Commit to complying with applicable laws and regulations, and maintain platform rules (including but not limited to this User Code of Conduct);

Ÿ   18 years of age or older and duly authorized by a qualified Live Broadcast Company.

For companies or organization users (“Live Broadcast Company”)

Ÿ   Pass through the company verification process of DingTalk;

Ÿ   Authorize the Broadcaster to hold broadcast;

For live broadcast audience (“Audience”),

Ÿ   Register as a DingTalk user;

Ÿ   Must be in the same company or organization with the Broadcaster;

Ÿ   Not allowed to hold any live broadcast.

General Don’ts for Your Behaviours on the Platform

Ÿ   Violating the basic principles established by applicable laws and regulations, or publicizing, publishing or sharing illegal information or information that violates social morality;

Ÿ   Directly or indirectly interfering with other users’ use of DingTalk, harming the operation and security of DingTalk’s services or DingTalk’s brand by any means or behaviour;

Ÿ   Promoting terrorism, crime, or other types of behaviour that could cause harm;

Ÿ   Disseminating content that depicts or disseminates child abuse, child nudity, or sexual exploitation of children, content depicting minors engaged in delinquent behaviour, or any other content harmful to the physical and mental health of children;

Ÿ   Publicizing or showing content that promotes self-harm or suicide;

Ÿ   Disseminating obscene, indecent, false, menacing, offensive information by any means or behaviour;

Ÿ   Promoting or glorifying abject violence or suffering, or publishing content that is excessively gruesome or shocking or sexually explicit or gratifying;

Ÿ   Violating privacy or divulging personal information of others without valid permission;

Ÿ   Involving sensitive, restricted or prohibited topics and items as where you locate, such as national security, religious freedom, political criticism, drug abuse, prostitution, obscenity, illegal gambling;

Ÿ   Publishing or distributing content that infringes someone else’s intellectual property rights;

Ÿ   Engaging in any other activities as restricted or prohibited under this User Code of Conduct and its Appendix.

Rights and Responsibilities

Ÿ   You shall judge on your own the contents you access in using the live broadcast services of DingTalk, and undertake all risks arising out of using the contents, including risks arising from reliance on the accuracy, completeness or practicability of the contents.

Ÿ   We encourage parents to be aware of and exercise necessary control over content posted to their children in order to keep them safe and health online.

Ÿ   You are responsible for protecting your devices against interference, spyware or viruses that may be encountered. We recommend you install necessary virus protection program on your devices and keep it up to date.

Ÿ   You may use the “Report” function within the live broadcast platform to report any violations of this User Code of Conduct. You may also contact us via customer service within the DingTalk app.

Ÿ   DingTalk is not required to monitor the data and information uploaded, transmitted or shared by you in real time, provided, however, that DingTalk has the right to review and supervise your use of the services and take corresponding actions, including but not limited to removing certain content, suspending or terminating the services, and reporting to the relevant authority.

Ÿ   Nothing related to your use of the live broadcast platform either as a Broadcaster or an Audience will be construed as creating an employer-employee relationship, a partnership, joint venture, association, or agency relationship with us, or as a limitation upon our right to terminate your access as foreseen above, or upon our discretion, to terminate your access as provided. You assume all risk for your use.

Ÿ   You shall expect no compensation in any form from DingTalk for any content you submitted or contributed to the live broadcast platform of DingTalk.

Ÿ   All your activities on DingTalk are also governed by the DingTalk Terms of Use and the DingTalk Privacy Policy.

Ÿ   DingTalk reserves the right to change, upgrade, modify or transfer the services or any part of DingTalk’s services and the relevant functions and applications at any time at its own discretion. You agree that DingTalk is not required to notify you of and will not be liable to you or any third party for such change, upgrade, modification or transfer by making publicity on DingTalk official website (www.dingtalk.com).

Content Review and Platform Management

We reserve the right, at our sole discretion, and without any obligation to review to do so, to review and remove content without notice.

If we discovers or receives report from others that you have violated this User Code of Conduct, DingTalk is entitled to delete and block relevant contents at any time without any notice, and take the measures including but not limited to repossessing your account, restricting, suspending or terminating your use of all or part of the DingTalk service, and holding you legally liable for your violation of this User Code of Conduct.

Appendix

Unacceptable Behaviours on DingTalk Live Streaming Platform

Offering a safe and supportive environment is our top priority. We also believe that feeling safe and comfortable is essential to a good user experience for DingTalk’s users. When you use the live streaming service on DingTalk, please strictly abide by the following guidelines and avoid any unacceptable behaviours as illustrated below.

1.      Dangerous individuals and organizations

We do not allow dangerous individuals or organizations that engaged in any violent activities to use our platform to promote terrorism, crime, or other types of behaviour that could cause harm. Content that express support or praise for such dangerous individuals and organizations or their activities are not allowed, either. Any names, signs, slogan or other symbols that represent such dangerous individuals and organizations or their activities are also prohibited on our platform, unless for justifiable purpose like education, history study. When there is a credible threat to public safety, we handle the issue by removing the account and cooperating with relevant legal authorities.

Dangerous individuals and organizations include in particular those involved in the following:

Terrorist activity

Organized violence

Organized hate

Mass murder (including attempts) or multiple murder

·       Homicide

Human trafficking

Human trafficking

Organ trafficking

Arms trafficking

Drug trafficking

Kidnapping, extortion, blackmailing, money laundering, fraud, cybercrime or other criminal activity

2.      Criminal activities

We prohibit the depiction or promotion of criminal activities. Some content may be removed if it relates to activities that are illegal or regulated in the majority of the region or world, even if the activities in question are legal in the jurisdiction where you locate. No content that promotes criminal activities shall be displayed on our platform:

Content that promotes acts of physical harm, such as assaulting or kidnapping

Content that risks the safety of others, including pranks like swatting

Content that promotes human exploitation or wildlife trafficking

Content that offers the purchase, sale, or trade of unlawfully acquired goods

Content that provides instructions on how to conduct criminal activities

3.      Regulated items

We prohibit any acts or attempts by individuals or organizations to sell, purchase or otherwise trade restricted goods or services. No such related content is tolerated on our platform.

3.1.      Sale or use of weapons

Content that displays firearms, firearm accessories, ammunition, or explosive weapons

Content that offers, sells, trades, or solicits firearms, accessories, ammunition, explosive weapons, or instructions on how to manufacture them

3.2.      Drugs and controlled substances

Content that displays drugs, drug consumption, or encourages others to make, use, or trade drugs or other controlled substances

Content that sells, offers, trades, or solicits drugs or other controlled substances

Content that provides information on how to buy illegal or controlled substances

Content that depicts the trade (buying or selling) of human blood

Content that attempts to sell animals that are regualted

3.3.      Frauds and scams

Content that promotes phishing

Content that promotes Ponzi or pyramid schemes

Content that promotes fixed betting, get-rich-quick schemes, or any other types of scams

4.      Minor safety

We are deeply committed to child safety and have zero tolerance for predatory or grooming behaviour toward minors. Content that may harm child safety include for example the following:

4.1.      Nudity and sexual exploitation or sexual activities involving minors

Content that shows the private parts of minors

Content that depicts sexual exploitation of minors

Content that depicts sexual activities such as penetration, non-penetrative sex, or oral sex involving minors

Content that depicts sexual arousal involving minors

Content that depicts a sexual fetish involving minors

Content that depicts erotic dances involving minors

Content that contains sexual or erotic language involving minors

4.2.      Underage delinquent behaviour

Content that depicts minors consuming, possessing, or suspected of consuming alcoholic beverages, drugs, or tobacco

4.3.      Child abuse

Content that depicts physical or psychological abuse involving minors

4.4.      Grooming behaviour

Content that encourages, instructs, or justifies grooming behaviour

Content that engages a minor in a sexually explicit conversation

Content that incentivizes or blackmails a child to transmit sexually explicit material

Content that constitutes or facilitates inappropriate interactions with children

5.      Violent and graphic content

We do not allow content that is excessively gruesome or shocking, especially that promotes or glorifies abject violence or suffering. Violent content include in particular the following:

Pictures or videos of people or dead bodies in non-medical settings that is gratuitously shocking, sadistic, or excessively graphic, for example, visible internal organs, Throat-slitting, repeated child abuse, etc.

Content describing the slaughter of real animals or animal cruelty

Videos depicting humans killing animals in violent manner

Content regarding depictions of dismembered, mutilated, charred, or burned animal remains

6.      Suicide, self-harm, and dangerous acts

We do not promote participation in activities that could lead to harm. We also do not permit users to encourage others to take part in dangerous activities. Users shall not post any content that:

6.1.      Suicide

Content that provides instructions on how to commit suicide

Content that praises, promotes, or glorifies suicide

Content that depicts graphic self-injury imagery

6.2.      Self-harm

Content that shows self-inflicted wounds

Content that provides instructions on how to commit self-harm

Content that supports dangerous and unhealthy behaviour to lose weight

6.3.      Dangerous acts

Content that shows the inappropriate use of dangerous tools

Content that depicts drinking liquids or eating substances not meant for consumption

Dangerous challenges that might lead to injury

Content that depicts minors below the lawful age operating motor vehicles

7.      Hate speech

We do not tolerate content that attacks or incites violence against an individual or a group of individuals on the basis of protected attributes, such as race, ethnicity, religious belief and disability. In particular, users shall not post, share or use the following content on our platform:

·       Content that attacks the other person or a group of person regarding the race, color, religious belief, sexual orientation, disability, gender, immigration status and other protectable attributes

·       Content that dehumanizes or incites violence or hatred against individuals or groups, based on the attributes listed above, including but not limited to the content claiming that others are physically or morally inferior, are criminals; referring negatively to them as animals, inanimate objects, or other non-human entities; or otherwise referring negatively to them as animals, inanimate objects, or other non-human entities

Content that promotes any hateful ideologies by talking positively about or displaying logos, symbols, flags, slogans, uniforms, salutes, gestures, portraits, illustrations, or names of individuals related to these ideologies

Content that denies well-documented and violent events have taken place

Music, lyrics or videos that promote hateful ideologies

8.      Harassment and bullying

No harassment or bullying related content or behaviour is tolerated on our platform. Users shall not:

threaten an individual with violence, call for self-injury or suicide of a specific person;

Post content that wishes death, serious disease, physical, or other harm on an individual

Incites violence or coordinated harassment

Sexually harasses a user by disparaging their sexual activities or attempting to make unwanted sexual contact

Disparages a private individual on the basis of attributes such as intellect, appearance, personality traits, or hygiene

Praises violent tragedies and disparages their victims

Sends messages that contain targeted cursing or calls for serious disease or physical

Reveals or threatens to reveal personally identifiable information, including but not limited to residential address, private email address, private phone number, bank statement, social security number, or passport number, sexual orientation,

Threat to reveal sexual imagery or non-consensual intimate imagery

9.      Erotic information and sexual activities

We do not allow the display of any erotic and sexual information, pictures or activities on our platform, because many of our users may be sensitive to or get harmed by this type of content. Especially the following content is not allowed:

Content that shows or relates to sexual exploitation;

Content that depicts, commits, or incites non-consensual sexual acts

Content that commits, promotes, or glorifies sexual solicitation or sexual objectification

Content that depicts sexual activities such as penetration, non-penetrative sex, or oral sex

Content that shows human genitalia, female nipples, or buttocks

Content that depicts sexual arousal

Content that depicts a sexual fetish

Presence of by-products of sexual activity

Other pornography related content

10.    Integrity and authenticity

10.1.   Misleading information

We do not permit misinformation that could cause harm to users of DingTalk or the larger public. We may remove misinformation that could cause harm to an individual’s health or wider public safety. We also remove content distributed by disinformation campaigns.

Misleading information includes mainly the following:

that meant to incite fear, hate, or prejudice

that may cause harm to an individual’s health or property, such as misleading information about medical treatments

Hoaxes, phishing attempts, or manipulated content meant to cause harm

That posted as another person or organization by using someone else’s name, biographical details, or profile picture in a misleading manner

Authorize others to use the broadcaster’s account

Submit false information when registering an account

10.2.   Spam

Content or activity that seeks to artificially inflate popularity on the platform is prohibited. We also prohibit any attempts to manipulate platform mechanisms to increase interaction metrics. Any false or fraudulent increase of views, likes, comments, shares using unfair methods is prohibited.

10.3.   Intellectual property

We do not allow users to publish or distribute content that infringes someone else’s intellectual property rights. For example, users profile photo or content posted by users that violates or infringes someone else’s copyrights, trademarks, or other intellectual property rights.

11.    Cybersecurity

We do not allow attempts to collect our users’ information by deceptive or invasive methods are harmful to our platform, in particular, users shall:

Not gaining access to any account or user data other than your own without explicit permission from the account owner

not hack the DingTalk website, app, or associated networks, or bypass its measures to restrict users’ access

Not (attempt to) acquire or request another user’s login credentials, whether explicitly or through deceptive means such as phishing (e.g. fake surveys designed to capture log-in info or links to fake login pages or impostor websites)

Do not distribute files that contain viruses, Trojan horses, worms, logic bombs, or other materials that are malicious or harmful
